Petition filed in the Supreme Court regarding the use of PM Care Fund

New Delhi: A petition has been filed in the Supreme Court seeking PM Care Fund to be used only for procurement of corona vaccines and installation of oxygen plants in 738 districts as well as purchase of medical equipment. The petition was filed by Supreme Court Advocate Viplav Sharma and all eyes are now on the court's decision on the PM Care Fund.
The petition also requested MPs and MLAs from all states to use their funds in the constituency in a transparent manner during the crisis. All private and charitable hospitals should also provide information on how to supply medical oxygen to patients. The petition also seeks the attention of the Center and the states.

The petition seeks permission to use the PM Care Fund to start oxygen plants in all the 738 districts as many hospitals in the country do not admit patients due to lack of oxygen and facilities. Also on April 24, the Center had issued a notification to cancel import duty on medical equipment for three months. These notifications have also been challenged in the petition.

Earlier, a petition was also filed in the Delhi High Court against the PM Care Fund. It seeks to declare the PM Care Fund a 'state' as per Article 12 of the Constitution. Also, its audit report should be made public on the website of PM Care Fund. Two petitions have also been filed in the Delhi High Court seeking declaration of PM Care Fund as a public authority under RTI.
