Center should decide the participation of women in the armies -Delhi High Court order


- Said- Military, Navy; Give admission in Air Force Academy through CDS
New Delhi. The Delhi High Court has questioned the Center whether women can get entry into the Indian Military Academy (IMA), Indian Naval Academy (INA) and Air Force Academy (AFA) of the Indian Armed Forces through the Combined Defense Examination (CDS). The High Court has asked the Center to reply within 8 weeks.
The court gave this order on the petition of a petitioner named Kush Kalra. In this, Kalra had challenged a notification of UPSC issued in December 2023. In this notification, applications were invited for recruitment through CDS exam in Indian Military Academy, Indian Naval Academy, Air Force Academy and Officers Training Academy (OTA).
High Court said- Center should take decision as per law in 8 weeks
On Friday, Delhi High Court's Acting Chief Justice Manmohan and Justice Manmeet PS Arora took cognizance that the petitioner's petition in this matter is still pending with the concerned authority. The judges said that we are ordering the Center to take a decision regarding the representation of women under the law within 8 weeks. With this order we are disposing of this petition.
The petitioner said- it is wrong to keep women out of the exam on the basis of gender.
The petitioner had appealed that women have been unfairly excluded on the basis of their gender in the notifications of examinations conducted by IMA, INA and IAF. Women are allowed to apply for Short Service Commission only in OTA.
According to the petitioner, when the Defense Ministry has given entry to women in the NDA exam and the number of women recruited in the army is increasing every year, then there is no reason to recruit women in IMA, INA and IAF through CDS exam. The reason is not visible.
Appeal in the petition – Women's right to equality is being violated
The petition said that not giving the opportunity to eligible women candidates to take training in the biggest training institutes of the country is a violation of their fundamental right to equality. The Central Government allows unmarried male candidates with appropriate education to appear for the UUR examination and join the Indian Military Academy, Indian Naval Academy and Air Force Academy. However, eligible and interested female candidates are not allowed to take the same exam. And no correct reason is given for this.
