What is the Anti Paper Leak Law? -On which exams is it applicable? The guilty will get 10 years of imprisonment

New Delhi. To deal with crimes like paper leak, the government implemented the Anti Paper Leak Act 2024 in the country at midnight on Friday (21 June). This law has been implemented after the ongoing NEET UG controversy in the country.
Till now the central government and investigating agencies did not have any concrete law to prevent and deal with cheating and other irregularities in recruitment examinations. For this reason, incidents of paper leak keep happening often. Recently there is a controversy regarding the NEET exam and the UGC NET exam was canceled a day after it was conducted. After this, the Ministry of Personnel Public Grievances and Pensions issued a notification of this law on the night of 21 June.
Provision from 10 years imprisonment to 1 crore fine
The decision to bring this law amid irregularities in examinations like NEET and UGC NET is being considered a big step of the government. After the implementation of this law, there is a provision of imprisonment up to 10 years and a fine of Rs 1 crore if found guilty of leaking the paper.
Paper leak or use of unfair means...?
Under this law, leaking the paper or tampering with the answer sheet will be punishable with a minimum of 3 years in jail. It can be extended to 5 years with a fine of up to 10 lakhs. In case of non-payment of fine, additional punishment of imprisonment will be given as per the provisions of the Indian Justice Code, 2023.
If the service provider is found guilty, a fine of Rs 1 crore will be imposed
If the service provider appointed for conducting the examination is found guilty, then he will be fined up to Rs 1 crore. If the service provider is involved in illegal activities, then the cost of the examination will be recovered from him. Also, the service provider can also be barred from the responsibility of conducting any public examination for a period of 4 years.
If an institution is involved in committing organized crime, its property will be subject to attachment and confiscation and the proportionate cost of the examination will also be recovered from it.
Provisions if the officer is found guilty
If the crime has been committed with the consent or connivance of any director, senior management or persons in charge of the service provider firm, then they can be punished with three to 10 years of imprisonment and a fine of one crore rupees.
The law was approved on 12 February
The Public Examination (Prevention of Unfair Means) Act was passed by the Lok Sabha on 6 February this year and the Rajya Sabha on 9 February. President Draupadi Murmu approved the bill on 12 February and converted it into a law.
These examinations will be included
This law will include the examinations of Union Public Service Commission (UPSC), Staff Selection Commission (SSC), Railway Recruitment Board (RRB), Institute of Banking Personnel Selection (IBPS) and National Testing Agency (NTA). Recruitment examinations of all the ministries and departments of the Center will also be under the purview of this law. Under this, all crimes will be cognizable and non-bailable.
NEET controversy at a glance
Actually, the medical entrance exam NEET is in controversy these days. This exam was conducted by the National Testing Agency (NTA) on May 05. About 24 lakh candidates appeared in the exam. Allegations of paper leak started coming from the time of the examination. The controversy increased when a record 67 candidates secured rank-1 in the NEET UG result on June 4.
This happened for the first time
This is the first time in the history of NEET that such a large number of students have scored full 100% marks. In the year 2023, only two students got 100% marks. Allegations of paper leak and irregularities in the examination started coming from all over the country. The matter reached the Supreme Court, after which the Center canceled the score cards of 1563 students with grace marks and said that their examination would be taken again on June 23.
