High Court Delivers Blow to Sada Sarvankar; Major Relief for Thackeray Faction

Mumbai: The Bombay High Court has upheld the election victory of Shiv Sena (Uddhav Balasaheb Thackeray) faction MLA Mahesh Sawant in the Mahim constituency. The court dismissed the election petition filed by Sada Sarvankar, a former MLA belonging to the Shinde faction. This verdict marks a significant political victory for the Thackeray faction.
Mahesh Sawant had secured victory in the Mahim constituency during the Maharashtra Legislative Assembly elections held in November 2024. Sada Sarvankar had challenged this victory in the High Court. In his petition, Sarvankar alleged that Mahesh Sawant had concealed details regarding pending criminal cases while filing his nomination papers, thereby misleading the voters. Consequently, he demanded that the election be annulled and that Sawant be disqualified.
On Tuesday, arguments from both sides were presented before a single-judge bench presided over by Justice Arif Doctor. After taking into consideration all the evidence, legal provisions, and arguments presented, the court completely dismissed Sarvankar's petition. The court clarified that the allegations leveled did not constitute sufficient grounds to warrant the annulment of the election. As a result, Mahesh Sawant retains his position as an MLA.
Following this verdict, activists and supporters of the Thackeray faction expressed their jubilation. This decision is being viewed as a major setback for the Shinde faction. Mahim is traditionally considered a stronghold of the Shiv Sena. In the 2024 elections, Mahesh Sawant had defeated both Sada Sarvankar of the Shinde faction and MNS leader Amit Thackeray.
