Unnao Rape Case: Supreme Court's Shocking Decision; Kuldeep Sengar will not get bail, imprisonment continues

New Delhi: The Supreme Court today delivered a major blow to former BJP MLA Kuldeep Singh Sengar, who was convicted in the Unnao rape case in Uttar Pradesh. On December 23, the Delhi High Court had stayed Sengar's life sentence, paving the way for his bail. However, when the CBI filed an appeal against this decision in the Supreme Court, the bench immediately stayed the High Court's order. As a result, Sengar will remain in jail.
Sengar was charged with kidnapping and raping and gang-raping a minor girl in 2017. In December 2019, the trial court sentenced him to life imprisonment. Sengar had appealed against this sentence in the Delhi High Court, which created the possibility of his temporary release. However, this decision sparked a wave of outrage across the country. The victim's family protested in Delhi, and widespread anger was also expressed on social media.
The hearing took place before a bench of Chief Justice of India D. Y. Chandrachud, Justice J. B. Pardiwala, and Justice P. S. Narasimha in the Supreme Court. The CBI's lawyer, Solicitor General Tushar Mehta, highlighted the severity of the case, pointing out that the offense was proven under Sections 5 and 6 of the POCSO Act. The bench stated that the High Court's decision could lead to misinterpretation. It could be misused by public servants to get exemption from punishment. For example, a constable or a soldier could also use this as a basis, which would be dangerous for the justice system.
This decision has brought relief to those who were hoping for justice for the victim. The Unnao case has become a symbol of the fight for justice for rape victims. The judicial process is also underway regarding the murder charges against Sengar in the second case. The Supreme Court has given a date for the next hearing, and a verdict in this case is expected soon.
