“Celebrations While Forgetting Equality and Discipline? Court Issues Warning to Society”

Nagpur | The Nagpur Bench of the Bombay High Court has taken serious cognizance of the extensive noise pollution that occurred during the programs held at Constitution Square (Samvidhan Chowk) on April 14th to mark Dr. Babasaheb Ambedkar Jayanti. Reminding both the organizers and society at large of Babasaheb’s ideals, the Court unequivocally stated that Babasaheb himself would never have endorsed noise pollution.
The Court observed that Babasaheb’s birth anniversary is not merely a festive occasion, but rather a tribute to his ideals of equality, justice, and social transformation. Therefore, it is essential that his principles be propagated during such events; celebrating solely through loud music, sloganeering, and fireworks is inappropriate.
During the hearing, the *Amicus Curiae* (Friends of the Court) informed the Bench that the use of high-decibel sound systems, sloganeering, and fireworks during the event constituted a violation of noise pollution control regulations. In response, the Court directed that notices be issued to the organizers and further instructed the police administration to submit a report detailing the measures undertaken to safeguard the rights of citizens.
The Court further emphasized that every citizen possesses the fundamental right to live in peace. Excessive noise has an adverse impact on the health of the elderly, the infirm, and young children; it also causes distress to birds. Therefore, it is imperative to bear in mind Babasaheb’s profound thought: “Liberty must not be allowed to degenerate into license.”
The Court posed a pointed question to the organizers: Are Babasaheb’s principles truly being propagated while celebrating his birth anniversary? A deadline until June 9th has been granted to submit a clarification regarding this matter.
