Will Intervene to Ensure Fair Elections; Supreme Court’s Strong Statement – ??‘Our Hands Are Not Tied’

New Delhi, October 22, 2026: The Supreme Court has stated that building trust in the electoral process is crucial for democracy and the rule of law. Making a significant observation regarding fair elections, the Court clarified, “Our hands are not tied. If the fairness of an election is threatened by unconstitutional or illegal practices, we can intervene.” This observation was made by a bench comprising Justices Joymalya Bagchi and V. Mohana, while hearing a petition filed by the Yuvajana Sramika Rythu Congress Party (YSRCP), an opposition party in Andhra Pradesh. The party alleged that its candidates were prevented from filing nomination papers for elections to 100 local self-government bodies. The Supreme Court directed the Andhra Pradesh State Election Commission (SEC) not to announce the final list of candidates for 19 of these bodies. However, the Court declined to alter the polling date, which is set for October 28. It further instructed the Commission to look into complaints regarding the use of force to prevent the filing of nomination papers. Free and fair elections are a fundamental part of the Constitution. During the hearing, the Supreme Court remarked that free and fair elections constitute a fundamental aspect of the Constitution, and the right to participate in the electoral process—by filing nomination papers—is a vital component of this. The responsibility for conducting and overseeing local body elections lies with the State Election Commission (SEC). The Court further clarified that while the independence of electoral authorities must be preserved and elections should be completed within the prescribed timeframe, courts cannot be precluded from exercising judicial review when the fairness of an election is called into question. “Constitutional courts are the guardians of constitutional values. When an opposition party presents evidence to support allegations of interference in the electoral process, the courts cannot remain helpless,” the court asserted. This has been noted as a significant observation that clarifies the role of a constitutional court.
